Liability Waiver Agreement

Indoor Playground: HyperZone

Location: Massachusetts

WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

This Waiver of Liability, Assumption of Risk, and Indemnity Agreement ("Agreement") is executed on this 26.08.2024, by the undersigned participant ("Participant") and/or the parent or legal guardian of the Participant (if Participant is under 18 years of age), in favor of HyperZone, its owners, directors, officers, employees, agents, representatives, and all other persons or entities acting on its behalf (collectively, "HyperZone").

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
The Participant acknowledges and agrees that the use of HyperZone's facilities, equipment, and participation in activities conducted by HyperZone involves inherent risks and dangers, including, but not limited to, physical or emotional injury, paralysis, death, and damage to property. The Participant voluntarily assumes all such risks associated with participation in activities at HyperZone, whether known or unknown, and accepts full responsibility for any injury or damage that may occur.

2. WAIVER AND RELEASE OF LIABILITY
In consideration of being allowed to participate in activities at HyperZone, the Participant, on behalf of themselves and their heirs, assigns, personal representatives, and next of kin, hereby releases, waives, discharges, and covenants not to sue HyperZone from any and all liability, claims, demands, actions, or causes of action, including negligence, that arise out of or are related to any loss, damage, or injury, including death, that may be sustained by the Participant, or to any property belonging to the Participant, while participating in any activity conducted by, or in the premises of, HyperZone.

3. INDEMNIFICATION
The Participant agrees to indemnify, defend, and hold harmless HyperZone from and against any and all damages, costs, claims, demands, expenses (including reasonable attorney's fees), and liabilities of any kind arising out of or related to the Participant's use of the facilities and participation in activities at HyperZone.

4. MEDICAL AUTHORIZATION
The Participant grants permission to HyperZone to authorize emergency medical treatment as deemed necessary, including transportation to a medical facility, and agrees to be responsible for all costs associated with such treatment.

5. PHOTOGRAPHY AND MEDIA RELEASE
The Participant consents to the use of their image, likeness, and voice in photographs, videos, and other media recorded at HyperZone for promotional and marketing purposes, without compensation.

6. SEVERABILITY
If any portion of this Agreement is found to be void or unenforceable, the remaining provisions shall remain in full force and effect.

7. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law principles.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND THAT I AM VOLUNTARILY WAIVING CERTAIN LEGAL RIGHTS.
